CHANDIGARH India: The Central Coordination Committee of the Gurdwaras and Sikh institutions Chandigarh General Secretary Ranjit Singh Riar has challenged in the Punjab and Haryana High Court through writ petition vires of section 268 of the Cr.P.C under which some persons re detained in Nabha and Sangrurjails. It has been alleged in the petition that hundreds of persons are being detained in the jails without any remand and trial for the last many months. It has been further stated that the State of Punjab or District and Session Judge Patiala or any other officer should be appointed to make available the details of all detained. The detainees are stated to be denied the normal trial and thus violating their fundamental rights guaranteed under the constitution. It was contended by Amar Singh Chahal. Gurdeep Singh Chahal and Narinder Singh Minhas that the wit involved significant point of law in as much as questioning this order and striking down of section 268 Cr.P.C. The detainees in the jails should be either freed or produced in various courts of Punjab for trial. The Bench consisting of Chief Justice Mr. Justice H.N. Seth and Justice Ujagar Singh issued notice to the state of Punjab for Dec. 6 1986.
