NEW DELHI: The Supreme Court on Friday ordered fresh elections on April 28 to the executive council of the Indian Olympic association (TOA) to settle the dispute in the Apex sports body.

The court appointed a retired Supreme Court judge justice A D Koshal to convene the general assembly of the association on April 28 at Calcutta and conduct the election as per rules and regulations of the association.

The elections should be held within two months and the voting shall be by ballot a division bench comprising the chief justice Ranganath Misra justice M H Kania and justice Kuldip Singh in their 13-page judgment ordered.

The court pronounced the judgment on petitions by V C Shukla BS Adityan and others in the IOA case.

The court directed that the list of voters be settled within four weeks from now. The judge’s authorized justice Koshal to settle the issue.

The court also directed that any litigation if at all should be within the jurisdiction of the Delhi high court and no other court in India would entertain any litigation relating to the functioning of the LOA in any aspect.

The judges observed: It is unfortunate that the highest sports body of the country got involved in group fighting leading to litigation. The objectives of the society have been lost sight of and the representation of India in the international Olympic committee has been in jeopardy.

This therefore does not appear to us to be a situation where rights will have to be worked out by referring to the provisions of law relating to meeting and injunctions they observed.
