Earlier in the day, in a so moto action, a division bench of the High Court ordered the suspension of the interim anticipatory bail granted to the main suspect in the Naina Sabni murder case and declared that the ‘police was free to arrest him now.

The bench, comprising Justice T.S. Arunachalam and A. Thangamani also noted that the interim bail had been granted in “very great haste” without finding out the nature of the allegations against the accused from the New Delhi Police.

An “emergency notice could have been ordered,” the bench felt. “All this only goes to show what money could go to law,” Justice Aruanachalam was heard commenting to the public prosecutor after he disposed of the case. The bench further directed the registry to communicate to the Metropolitan Magistrate its orders suspending the interim bail and ask him not to execute the bail bond if Sushil Sharma appeared before it.

In passing it also made a veiled reference to the fictitious address given by Sharma in his bail application and remarked wryly, “If there is any doubt about the address, as it looks like prime facie from the Press reports the notice to Sharma may be communicated to his New Delhi address.
