CHANDIGARH: Justice S.S. Grewal of the Punjab and Haryana High Court issued notices for February 10 to the Home Secretary Punjab and S.H.0.s of police stations Kharar Morinda and Mohali in a habeas corpus Petition filed by Ujagar Singh a senior leader of the Bahujan Samaj Party for the release of Man Singh and Balbir Singh both candidates from the Kharar and Morinda constituencies respectively who are allegedly detained by the police in their respective houses.
The case of the petitioner was that both candidates were kidnapped by the police on January 31 at about 10 a.m. just after they filed their nomination papers in the office of S.D.M.-cum-Returning Officer Kharar. The party workers brought the sad fact to the notice of the observer who directed the police to release both of them forthwith so that they might be able to complete the formalities of scrutiny of nomination papers and administration of oath by the returning officer. Seeing that the police authorities did not bother to comply with the direction of the observer telegrams were sent to the Chief Secretary Punjab and the Election Commissioner New Delhi but to no avail Ultimately the High Court had to approach through a petition to seek release of the detainees
