CHANDIGARH: The UAD (T) on April 9 expressed deep concern and resentment over the “judicial may men of legal process” by the Government by implicating Mr. Simranjit Singh Mann and others in the Indira Gandhi assassination case.
In a joint statement issued here, Mr. Parkash Singh Majitha, Mr. Manjit Singh Calcutta and Bhai Shaminder Singh, UAD (T) leaders, said they had long ago lost faith in the law of the land. They were of the view that the Congress (1) was indulging in reelection tactics to overplay the issues to win over the majority community vote on communal lines to repeat its 1985 performance.
The Haryana Janata Party leader Mr. Amarjit Singh Sukhija said in a statement that it would be an injustice not only with Mr. Mann but also with this country if a trial was allowed to be held on the basis of an “invalid investigation” conducted by Special Investigation Team.
The legal position regarding BaTbir Singh was clear from section 300 of the CRPC which said that a Person once convicted or acquitted could not be tried again for the same offense. The position legally speaking regarding Mr. Mann and others was closely connected with the trial of Satwant Singh and others.
Mr. Sukhija said there were certain questions which need to be answered: Why the earlier investigation did not find anything against Mr. Mann and others now named by the SIT, could the court now go into the entire matter of earlier investigation also along with this investigation to find out the truth once again when the highest court of the country had given its verdict already; Why the SIT did not apply to the trial court or the Appellate Court to stay the proceedings, since more evidence was being collected; was this second investigation valid without formal permission of the trial or Appellate: Court where the matter was pending.
