New Delhi — Additional sessions judge Mahesh Chandra on Tuesday suspended an order of a magistrate allowing the lawyers and relatives to meet the persons arrested in the espionage case.
The accused are presently in judicial us today.
Additional chief metropolitan magistrate Bharat Bhushan had on Monday allowed the lawyers and relations to meet the accused.
Special public prosecutor B. R. Handa in his petition alleged that the blanket order passed by Mr. Bharat Bhushan was not in accordance with the Punjab jail manual rules where the powers to allow meetings had been delegated to the superintendent of jails.
The petition alleged that the order was being misused as some ‘‘undesirable information’’ was being passed on to the accused persons in jail which would hamper the investigation of the case.
The petition said it was the prosecution’s right to have an independent investigation and it should not be hampered by the accused and their relations under the protection of the blanket order.
Mr. Mahesh Chandra issued notice returnable on Wednesday to counsel for the accused.
