New Delhi — The widow of Beant Singh, who died in the shooting following Indira Gandhi’s assassination, October 31, and her brother on Tuesday prayed in a petition filed before the additional chief metropolitan magistrate Mr. S. L. Khanna, for the trial of two commandoes posted at the Prime Minister’s residence for the murder of Beant Singh.
The petition contended that there was sufficient evidence to try subedar Tarsem Singh Jamwal and constable Ram Saran of the former Prime Minister’s security staff for the offenses under Section 302 of the Indian penal Code and section 27 of the Indian Arms Act.
Mrs. Bimla Khalsa and Mr. Shamsher Singh in their petition urged the court for the summoning of the two accused and calling for the record of investigation and the first information report no. 241/84 in this connection. “In the alternative, this petition be treated as a criminal complaint and the petitioners be allowed to lead evidence in support of their contention,” the petitioners further prayed.
They alleged that from the evidence it was abundantly clear that Beant Singh was murdered in the same transaction in which Indira Gandhi was assassinated.
“For the Mala fide intention on the part of the state and in order to save the real culprits and also to create suspicion in the mind of general public the state has not put up challenge against the murderers of sub inspector Beant Sing”’ the petitioners alleged.
They alleged that subedar Tarsem Singh Jamwal and constalbe Ram Saran murdered Beant Singh in the guard room after he had surrendered.
