CHANDIGARH: A Division Bench consisting of Justice Amarjeet Chowdhary and Justice H.S. Bed dismissed the writ petition filed by Parkash Singh Badal, former Chief Minister of Punjab, and Sukhdev Singh Dhindsa, a former minister they had filed the petition to restrain the state of Punjab from sending the Punjab police to other states, particularly Himachal Pradesh, Assay and Andhra Pradesh, as the police force lot each state was constituted by the state government for its own pure pose and deploying this force in any other state was not permitted under any law, rule or the Constitution.
HS Matiewal appearing for the petitioners, contended that the Punjab police lad been constituted by the slate government for its own internal law and order and could not constitutionally deploy its man in other state, Moreover, the special police forces like CRPE. ITBP and RPF had been recruited by the Center for deployment anywhere in the country as and when the situation demanded, it was further contended by counsel for the’ petitioners, that it was the duty of the Union Government to protect any state’ from internal disturbance. There was no reason whatsoever to send the Punjab police force to another state: when the Center had got reserve police force. This process also affected the image of the Sikhs in the country.
H.S. Sidhu, Assistant Advocates General, appearing on behalf of the: state, contended that the petitioners, had riot locus stand to file the present writ petition, as they were not affected by any order of the Government. He further contended that ac: cording to Section 3 and 4 of the Police Act, 1988, and rule 1.5 of the Punjab Police Rules, the police force could be deployed in any part of the country in the interest of the country’s unity and integrity and for maintenance of law and order After hearing the panics the Bench diminished the writ petition.
