BOMBAY: The Central Bureau of Investigation has proposed before the TADA court hearing the serial blasts case that it would not like to press the chargcol waging war against the government of India against members of the Memon family, who are the prime accused in the conspiracy.
The Chief CBI prosecutor, V. Natarajan, told the designated TADA court Judge J.N. Patel that since the investigating agency had no evidence to substantiate the earlier charges, that charge may be replaced with a Lesser charge or intending to destroy peace and harmony of the country. Members of the Memon family, along with Dubai based don, Dawood Ibrahim are the prime accused in the conspiracy behind the serial bomb blasts that shook the metropolis in March 1993. The brain behind the conspiracy, Tiger Memon, is still missing.
Natarajan said the new proposal was based on the evidence in hand, and if they could find the requisite evidence then the earlier charge of waging a war against the nation could be revived at a later stage.
When the police filed the charge sheet, two charges: conspiracy to wage war against the government of India and ever throwing the government established by law were commonly proposed against all the 192 accused.
Eight members of the Memon family Abdul Razak Hanifa, Yakub Memon, his wife Rahin, Suleiman, his wife Rubina, Issa and Yusuf-are currently under detention and are among the 192 persons who are being tried for the bomb blasts.
