The Immigration Act of 1990 provides 10,000 visas per year for individuals who will establish a new commercial enterprise in the United States and thereby create jobs for U.S. workers. Under the statue, a per son may qualify for the employment creation visa by investing $1 million or more in a new commercial enterprise which creates not less than 10 jobs for persons other than the investors spouse or sons or daughters. If the enterprise is established in rural area or in 2 high unemployment areas, the necessary capital may be less that $1 million. On the other hand, if the en expires i established in an area with low unemployment, the capital requirement may be more than $1 million, AS a further inducement for investors to locate their operations in certain areas, 3,000 visas per year are reserved for investors in the high unemployment or rural areas, This employment creation visa may be of special interest to persons from. counties which have no investor or trader treaty with the US. (I.e. India).
