By Our Staff Reporter NEW YORK: The government is scheduled to file an answer to the habeas corpus filed by attorneys for Ranjit Singh Gill and Sukhvinder Singh and submit its memorandum of law on or by October 11, 1989.
This was agreed on by Ms. Mary Pike and Ronald L Kulby attorneys for the respondents and Ping Moy a newly assigned council. representing the governmental defendants at a status conference with Judge Robert W. Sweet of the U.S. District Court for Southem District Of New York,
The council for respondents will then submit their memorandum of law in reply to the government and or by Nov 8 after which they will hold another status conference.
Earlier on June 29, Judge Sweet had denied the governments motion for a change of venue from New York to New Jersey.
“The Government has failed to meet its burden of establishing the need for a change of form. There is minimal if any, inconvenience caused by returning the action in this district,” he had said in his decision.
The decision was hailed by the Sikh leaders since it was felt that the transfer this extradition case to New Jersey, where the prosecutor. Judy Russell had been let off lightly despite of her misconduct, would be prejudicial to the respondents.
