CHANDIGARH: Justice G,S. Singhvi and Justice $.S. Sudhalkar issued notice to the Home Secretary and IGP, UT, Inspector Vijay Kumar, Sub Inspectors Maghi Ram and ‘Sukhbir Rana and ASI Surinder Kumar of the Chandigarh police in a case alleging third-degree torture by them, including castration of one of the petitioners.

Counsel for the petitioners, Man Bahadur, Kumb Bahadur and Rajesh, who are citizens of Nepal, said that the police officials brutally tortured the petitioners to make them confess 40 some thefts committed in and around Chandigarh.

The cops administered electric shocks on the private parts of the petitioners and castrated Man Bahadur, in the nightmare of police remand spanning over two months, the petitioners were hung upside down and Sub Inspector Sukhbir Rana even urinated in the mouth of Rajesh.

The advocates further claimed that when Man Bahadur lost consciousness after being castrated, he was immediately taken to the PGI, where he was forced to state before the Duty Magistrate Ram Singh Chaudhry that he had tried to commit suicide.

The Court was also told that the detainees brought the facts to the notice of magistrate and Sessions Judge, Chandigarh, Amar Dutt, but no action was taken by them. None of the magistrates before whom the detainees were produced made any legal aid available to them.

While praying for their medical examination by a board of doctors, the petitioners also sought a CBI inquiry into the whole incident and registration of criminal cases against the police officials besides compensation to the petitioners.

Navkiran Singh, Harshinder Singh, Praveen Kumar Sharma and Tejinder Singh Sudan, represented the petitioners.

Ashok Agarwala, senior advocate for the UT was served with a notice for March 12.
