NEW DELHI: Chief election commissioner TN Seshan said on Tuesday that elections in Punjab can be cancelled by amending the law but the amendment will not be simple.
My reading of the law is that annulment of the poll in Punjab is not possible without amending the law. If they (government) amend the law it is not going to be a simple amendment but a very important one if and when it is done’ Seshan told PTI in an interview here.
Asked if the commission had been against holding of polls in the troubled border state Seshan said that the commission’s advice to the government was far not holding the poll.
Seshan said he postponed the elections in the state to September 25 as the accumulation of the evidence that built up did not justify the confidence of being able to conduct free and fair polls on June 22.
Asked why he took the decision to defer the polls on his own without consulting the government the CEC said I have no comments to offer.
To a question whether the commission would consider advancing the poll date in the troubled State in case the situation improved Mr Seshan said the commission is always alive lo suggestions in this regard. But the significant question of law and interpretation will have to be taken into account.
