NEW DELHI: The Akali Dal leader Mr S.S.Mann on Monday filed a writ petition in the Supreme Court challenging the Terrorist and Disruptive Activities (Prevention) Act (TADA) under which he was “illegally” detained from November 26 to December 10 last year and also demanded compensation of Rs 5 crore from the Union of India and the state of Punjab.
Mr Mann said that he was arrested from the residence of his sister as a preventive measure to restrain him from going to Anandpur Sahib in Ropar District where the top leadership of different Akali Dals was scheduled to meet in their bid to forge the unity of different Akali Dals. Later he was informed that he was arrested under Section 4 of TADA he added.
Dr B.L Wadhera advocate who represented Mr Mann told the division bench of the court comprising Justice Ratmavel Pandian and Justice Jayachandra Reddy that he was challenging TADA under Article 21 of the Constitution which stipulates that no person shall be deprived of his life or liberty except according to procedure established by law.
