Punjab: Mr. Justice S.S. Grewal of the High Court issued a notice to the Director General of Police, Punjab and S.S.P. Ludhiana in a habeas corpus petition for the production and release of Gurcharan Singh Saidpur from the alleged illegal custody of Ludhiana police.
The alleged detainee an active member of the All India Sikh Student Federation. He had been
framed by the police in murder of Mr. Hitabhilashi, former President of the Punjab unit of the B.J.P.
In the petition filed by Mr Sardool Singh, the uncle of the alleged detainee, said on January 26, 1989, Gurcharan Singh was taken away by the police party from near Mohali and he was interrogated by S.S.P. Ludhiana. The petitioner stated that the where about of the detainee were not being disclosed to his relatives and it was apprehended that he might be killed in same staged encounter with the police. The petitioner prayed for the production of the detainee in the court.
After hearing Mr. B.S. Guliani counsel for the petitioner, the Judge issued notice.
