LUCKNOW: A division Bench of the high court comprising Mr. Justice S. Saghir Ahmad and Mr. Justice HN. Tilahari has stayed the proceedings of Justice K.P Singh inquiry commission appointed to inquire into the killing of 11 Sikhs alleged to be militants by the Pilibhit police in July.
“The order was passed on a writ petition filed by Mr. Bhikha Singh whose two sons were killed in the encounter.
Arguing on behalf of the petitioner Mr Umesh Chandra former advocate-general of U.P. contended that the Justice K.P. Singh inquiry commission was illegally constituted as the state government had issued a notification to the effect that the probe would be conducted by siting judge of the Allahabad High Court. He said that Mr Justice K.P. Singh had retired on August 1 and after his retirement the commission was illegally constituted on August 15.
It was further alleged that as per the notification the evidence was to be recorded in Pitibhit but ignoring the notification the commission was conducting the inquiry and recording: evidence at Allahabad causing inconvenience: and harassment to the persons concerned.
