OAKDALE LOUISANA: In Dr.Gurpartap Singh Birk’s deportation trial hearing his attorney Thomas P. Adams requested Honorable Judge R. Kevin McHugh for the hearing to be continued on August 13,1991 Adam’s main objection was that the Govt attorney changed the charges on Dr .Birk on a notice of 15 minutes. Adams told Hon Judge that it was unfair to his client to keep on changing the charges at short notices. Judge told Adams that the Govt had the right to change the charges. Again the special staff (a team of 6 specialists) from Washington was there. S. Harbhajan Singh Gill from Connecticut and S. Amolak Singh from New Orleans were present in the court for the testimony. Schumann the trial expert working on behalf of Dr.Birk was available over the phone.
Adams in a separate written motion requested the Judge to remove himself from this case. Adams said Your Honor with all due respect to you I would like to remind you that since you were presiding Dr.Birk’s Bond Hearing in which a lot of material was
by the Govt attorney which is not permissible in the deportation hearing and you happened to listen to it it is not humanly impossible for you to be neutral in his deportation hearing. This is by law a separate matter than the bond hearing. Judge refused to leave this case stating that it has to be a personal reason when a Judge needs to be removed. Adams is still working on a new motion in which he is giving more reasons to change the Judge… Sikh Community of Louisiana Texas and the neighboring states is going to Oakdale on Aug.17 for a Shabad Kirtan at the Oakdale Prison. Rev. Kenneth Logins of FCI Oakdale church service has arranged this prayer for Dr.Birk.
