Before the Judge, Mr. V. K. Ruikar,

Designated Court, Pune.

I, Sukhdev Singh (Sukha) son of Bhai Mehnga Singh Banwait, ama resident of 16-F, Karanpur (Rajasthan). I was arrested On September 7, 1986 from Pimpri Chinchwad railway station.

On September 2, 1988, this court while framing charges asked us: ‘‘Do you admit the charges leveled against you by the prosecution ?”? I denied the charges as these were 90% false. Then this court did not question me in detail, But I wanted to tell the truth. When I discussed this with my counsel he refused to plead my case. The Police had fabricated evidence and involved me in fake cases including Pimpri case. I wanted my counsel to argue the case and whatever I had done I would have owned at that time. But my counsel did not agree to this,

Both Har inder Singh and I had killed the tyrant General Vaidya. At that time we were riding (driving) a black Ind-Suzuki motor cycle. I was riding on the pillion with him. I had fired four shots at the tyrant General Vaidya. Later I came to know from a newspaper that one shot had hit his wife also. I had no intention of shooting her because unlike tyrant General Vaidya she had not committed any offence.

We had come to Pune on August 8, 1986. We stayed at a Gurdwara Sahib (Sikh Temple). Next day we picked up a black Ind-Suzuki motor cycle from the market area. On August 10, 1986, we both came out fo kill the tyrants General Vaidya and Lt. General Ranjit Singh Dayal. First, we surveyed the area around tyrant Dayal’s house. After that when we approached the tyrant General Vaidya’s house, his car was coming out.

We had seen his photographs in magazines and newspapers, Recognizing him and after chasing his car we put him to death.

Condemned Vaidya was the Chief of the murderer Dayal was a Lt. General, Darbar Sahib Indian Army and They had invaded our holy (Golden Temple) and forty other Sikh Shrines. They had killed thousands of innocent Sikhs and desecrated the Sikh shrines. They had used tanks and artillery to demolish Sri Akal Takht in the Darbar Sahib complex. Thousands of Sikh men, women and children were massacred mercilessly. This invasion was directed not only against Sant Jarnail Singh Ji Khalsa Bhindranwale but against the whole Sikh nation and the Same attack is still continuing, For this very reason, we killed the tyrant Vaidya, and had we got a job we would have stayed here and certainly killed the tyrant Dayal.

Under directions from the Government of India, the C. B. I. has implicated many innocent persons in this case so as to give it the semblance of a big conspiracy. These persons have been charged with conspiracy to kill tyrant General Vaidya, and abetting and harboring his murderers.

These persons include Balwinder Singh alias Binda, Nirmal Singh alias Nimma, Avtar Singh Randhawa, Yadvinder Singh Pirzada and certain other persons whose names I do not know. My charge-sheet is with my counsel, otherwise I would have copied those names from it. I neither have nor ever had any connection with the above-named persons or with others mentioned in the charge-sheet, with regard to this or any other case. Neither did I know them nor had I ever met them before.

I met Nirmal Singh for the first time in the Pimpri Police station. Other persons I saw only in the Yerwada jail.

This court has sentenced me to seven years imprisonment in the Pimpri case. This court had fo convict me on false evidence. False evidence even gets people hanged to death. I have nothing against this court for convicting me in the Pimpri case.

In the Pimpri case, Police Inspector Mr. A. I. Pathan along- with other police officials has shown me to be armed in order to make a false show of their bravery. If I had any weapon with me at that time and even if it had misfired, I would have recharged it and killed them all.

I am pleased to know that this court has acquitted Avtar Singh Randhawa and Yadvinder Singh as they had no connection whatsoever with me or with the Pimpri case or with any other case.

In the Pimpri case your decision on basis of the alleged confessional statement was correct; but I had never made any confessional statement to the Magistrate, Mr. S. L. Khatade or before any police officer. On the very first hearing after being charge-sheeted in the tyrant General Vaidya case I had submitted to you an application challenging the genuineness of this confessional statement.

The Punjabi Hindus have chosen to own Hindi in preference to their mother tongue Punjabi. They avow in Punjabi that their mother tongue is Hindi! They have projected the demands of the people of Punjab as the demands of the Sikhs and opposed them and started confronting the Sikhs dubbing them as terrorists and separatists. They considered the army invasion on the holy Darbar Sahib as their victory and celebrated it by distributing sweets. The Hindus rejoiced to see the Sikh religious places demolished and filled with dead bodies. The ninth Master of the Sikhs, Sri Guru Tegh Bahadur had gone to Delhi and attained martyrdom to save the religious symbols of these very Hindus. The Sikhs who are being confronted by these Hindus, made countless sacrifices for the country and against tyranny. They made 85% of the sacrifices for the emancipation of India,

A Hindu named ‘Chandu’ was responsible for the martyrdom of Guru Arjan Dev Ji and yet another Hindu, Gangu Brahmin, was intrumental in the martyrdom of Mata Gujri Ji and two sons of Guru Gobind Singh Ji.

In 1733 Zakria Khan had forced the Sikhs to leave their hearths & homes to live in jungles. They had to live on herbs and leaves. Anyone who caught hold of a Sikh was rewarded Rs. 100/- and the one who brought a beheaded Sikh was rewarded Rs. 25/-. At that time many Hindus and Muslims got numerous Sikhs arrested and slaughtered to get these rewards, History bears witness to these facts.

The present Hindu regime has also declared rewards for the heads of the Sikhs. Amongst these, Bhai Mathura Singh’s carried a reward of lakhs of rupees.

The invaders like Ahmed Shah Abdali, Nadir Shah, Zakria Khan etc attacked and plundered the Hindus and took away their women folk. But a handful of Sikhs counter-attacked the invaders, brought back the plunders, rescued the Hindu women and their daughters and restored them to their respective homes. And ever since 1984, what atrocities have not these very Hindus perpetrated on the Sikhs in Delhi and elsewhere in India? Their misdeeds are indescribable.

After losing the plunders to the Sikhs, Nadir Shah asked Zakria Khan who these people were. Zakria Khan replied that they were the Sikhs of Guru Nanak Dev, they lived on horse saddles and fought against tyranny. He added that he was pre- pared to offer the governorship of Punjab to the Sikhs if they would come to terms with him. But the Sikhs did not enter into any accord with the oppressors, and continued their fight against tyranny.

Our struggle is not against any religion or community, it is aimed to serve truth and end repression. The present regime con- siders this crime. They dub the Sikhs as extremists and terrorists, whereas the State itself is terrorist, which killed thousands of innocent Sikhs in the wake of the killing of the tyrant Indira (Gandhi) Brahmini. The guilty ones (H. K. L. Bhagat, Dharam Das Shashtri, Sajjan Kumar, Jagdish Tytler etc.) have not even been tried in the court. This regime has terrorized the Sikhs through its agents. The latest case is of Guru Nank Engineering College, Bidar (Karnataka) where twelve Sikh students were killed and several others injured, and the college was closed. The Press also blacked out this incident for four, five days and then gave it very insignificant coverage, whereas the Punjab news is unduly exaggerated. No action has been taken against the persons involved in this incident. In Maharashtra to a call for socio-economic boycott of the Sikhs was given and no one was punished for this. Any Sikh who avenges these devils is dubbed as an extremist and a terrorist. The Sikhs have to face bullets and are put behind the bars for voicing their rights. The government has compelled us to take up arms.

What type of the rule of law is this, that the persons responsible for gunning down the tyrant Indira Brahmini have been sentenced to death while the persons who master-minded the massacre of thousands of innocent Sikhs on the same day have been rewarded ministerial berths in the Central cabinet ? Is this the Constitution of India under which so much repression is let loose upon the Sikhs? Unlike other religions, the Sikh religion and the Sikh nation have not been given any recognition in India, although the Sikhs are a separate nation. The Sikhs are not safe under this Constitution.

Na Hum Hindu Na Musalman Allah Ram Ke Pind Pran

Kauh Kabir Eh Kia Vakhana Gur Pir Mil Khud Khasam Pachhana

This psalm has been quoted from the holy book of the Sikhs, Guru Granth Sahib (page 1136). The central idea of this psalm is—We are neither Hindus nor Muslims. The Government of India and the Hindus consider the Sikhs to be Hindus. They don’t recognize the Sikh religion and the Sikh nation as a separate entity. By reading this psalm the Indian Government and the Hindus will understand what the Sikhs are. Many other revelations to this effect may be quoted from the Guru Granth Sahib.

During the British regime the Government passed the Rowlatt Act. This very Congress had strongly opposed it. The same Congress has now passed the T. A.D. A. [Terrorist and Disruptive Activities (Prevention) Act] which has the evil import of a hundred Rowlatt Acts rolled into one. None among them has raised his voice against this black act,

Even the Indian Evidence Act has been amended to give unfettered powers to the Police. The world known concept of jurisprudence that a person is presumed to be innocent unless proved otherwise, has been turned topsy-turvy.

Not to talk of police, in this country even the first class magistrates give false evidence in the courts, as I have already explained to you and as you have also proved with your decision in the Pimpri case.

Every government dubs the revolutionaries fighting for their liberation as terrorists. The revolutionaries who liberated India were so named. One man’s terrorist is another’s freedom fighter.

Drafting Committee on November 25, 1949, had quoted Mr. B.D. Montesqiuson saying ;

“There is no cruder tyranny than that which is perpetrated under the shield of law and in the name of justice”.

The demand for a state of Khalistan is the result of the state terrorism let loose upon the Sikhs, which still continues unabated.

The war against the tyrants will continue till the attainment of Khalistan.

Every day we pray before God, “Raaj Karega Khalsa, Aaki Rahe Na Koi’’, which means, the pure ones shall have unchallenged sway and no one will be oppressed. How can the Guru’s Sikhs choose to live in a country where the Sikh youth are taken out of jails to be butchered or killed in false encounters, where thousands of Sikhs are falsely implicated in framed up cases and rot in jails without trial, and where their holy temples are being desecrated ?

“Raj Bina Na Dharam Chalay hai— Dharam Bina Sabh Dalay Malay Hai.’’

Sans political power Dharma (religion) cannot flourish; And irreligious life doth anarchy nourish.

I am prepared to make any sacrifice for the sake of Khalistan and the glory of the Sikh nation.
