CHANDIGARH: An ambiguity in the order issued by the Punjab and Haryana High Court in the Gill Bajaj case over the question whether the copy of the challan and other documents could be handed over to the counsel for Mr. K.P,S. Gill or not led to the adjournment of the hearing of the case 10 December 22.

The Chief Judicial Magistrate, Mr. Shekhar Dhawan, while adjourning the case last week, said that the matter had been pending in the High Court and was fixed for hearing on December 18. A clearer picture would emerge after hearing that day. He further noted that as per last week’s orders of the Sessions Judge, Mr. Amar Dutt, the CJM count would not take cognizance of the additional documents filed by the prosecution in the case while framing the charges.

The CJM further noted that the accused would have the right to raise objections about the admissibility and relevance of these documents during an appropriate stage of trial.

These documents include the secret official notes of the then Punjab Governor, Mr. S.S. Ray, his security adviser, Mr. J.F. Ribeiro and some other top functionaries at that time, which were sought to be attached with the FIR. These documents were procured allegedly by the complainant through her own sources. The Investigating Officer of the local police had, however, remained unable to get the same documents.
